What Are the Grounds for Divorce in Oklahoma?

Oklahoma primarily operates under a no-fault divorce system, meaning couples are allowed to get divorced without the need to prove fault (such as adultery or other marital misconduct). The most common ground for a no-fault divorce is incompatibility or “irreconcilable differences,” which refers to an irretrievable breakdown in the marriage.

The state also allows fault-based divorces on various grounds, such as abandonment, adultery, impotence, extreme cruelty, habitual drunkenness, and fraudulent behavior. These can have significant impacts on child custody, spousal support, and other key issues involved in the marriage dissolution. Working with a trusted attorney is critical to determining the right path to divorce and protecting your hard-earned assets.

What’s the Difference Between a Contested vs. Uncontested Divorce?

A contested divorce is a traditional path to marriage dissolution that involves court intervention to make important decisions about child custody, child support, spousal support, property division, and other key issues. On the other hand, an uncontested divorce is reserved for couples who agree on all divorce-related issues without the need for a judge to intervene.

Uncontested divorces are typically faster and more affordable than contested divorces, making them an appealing option for couples wanting to save time and money in the courtroom, reduce stress on young children, or enjoy more privacy during the divorce process. Our lawyers can evaluate your unique legal situation to determine if you meet the criteria for an uncontested divorce and help you take the first step toward a brighter future.

Am I Eligible to File for a Divorce?

Couples must meet certain eligibility requirements to file for divorce, including:

  • Residency. At least one spouse must have resided in the state for a minimum of six months before filing, and the divorce must be filed in the county where either spouse has lived for at least 30 days.
  • Grounds. Oklahoma allows no-fault and fault-based divorces on various grounds, such as incompatibility, adultery, impotency, fraud, and incarceration.
  • Waiting period. If minor children are involved, there may be an additional 90-day waiting period to finalize the divorce.

Our attorneys have a deep understanding of these requirements to help you complete the required forms, request any necessary waivers, and file a timely petition while protecting your best interests in and out of the courtroom.

How Is Property Divided During a Divorce?

Oklahoma follows the equitable distribution rule, meaning that family courts prioritize an equitable division of property during a divorce. However, “equitably” is not the same as “equally.” The court may assess a variety of factors to determine a fair and equitable distribution of marital assets. Some potential influencing factors include:

  • The duration of the marriage
  • Each spouse’s financial needs
  • Each spouse’s contributions to the marriage
  • Each spouse’s income, debts, earning capacity, and education level
  • Any history of marital misconduct, such as substance abuse or financial irresponsibility

At Schumacher Law Group, our lawyers have a deep understanding of the equitable distribution process to protect what’s rightfully yours.
